  • The National Energy Board's ("NEB") jurisdiction over the Coastal GasLink Pipeline Project. You can watch here.

  • The bill repealing the NEB Act and, among other things, introducing the Canadian Energy Regulator Act. You can watch here. The Bill goes to the Standing Senate Committee on Energy, the Environment and Natural Resources on February 5.

  • At the Supreme Court of Canada ("SCC"):

  1. The Chevron Case which is a case that decides whether to hold a seventh-level subsidiary located in Canada liable for actions of its parent in another country. Plaintiffs applied for leave to SCC in June 2018. I previously written about this case here.

  2. The Nevsun Case which was recently heard at the SCC and looks at liability for Canadian companies in relation to their foreign operations that are contrary to established precedent. Namely, the case looks at whether Canadian courts can decide on legality of sovereign acts of a foreign state in its own borders.

  3. The Barton Case which is a case that I wrote about that caused national protests and eventually led to the appeal at the SCC. This is the case that is normally referred to as the Cindy Gladue case.
