On-Reserve School Bus Company Cancels Bus Services On-Reserve over COVID-19 concerns

From my client: Boissoneau Bus Lines (the “Company”) has been serving the Algoma District, primarily busing Garden River First Nation students into school boards in the city of Sault Ste. Marie, Ontario for over thirty (30) years. The Company also recognizes the difficult situation regarding COVID-19 during this time. With the current COVID-19 situation, the Company has made the difficult decision to not bus in students to their schools come Tuesday September 8, 2020. This difficult decision has not come without serious consideration and concern for the children of the Garden River First Nation. The Band has a special duty to the children and this duty trumps any other contractual obligation between the Company and the Band. Our first priority is and always will be the children. As the COVID-19 situation continues, the Company has neither received direction nor support from the Band and the Band’s actions, through no fault of our own, frustrate our own duties under our agreement with the Band. Until we receive direction and approval from the Band regarding operations and COVID-19, we cannot operate safely. Please contact our lawyer for any further comments/questions. PDF here.
